As well as a traditional fees-clerk service, Billbe can pay up to 94% of your invoices. In terms of the traditional service, Billbe will:
Upload your costs agreement;
Provide you with free, intuitive software developed by Billbe Australia Pty Ltd (ABN 69 096 758 280) that records the information (your hourly rate as well as client and matter details) you need to generate an invoice in accordance with your costs agreement; and
Provide you with a dedicated and experienced account manager who will manage the process of collecting payments from your clients.
In terms of the prompt payment of your invoices, Billbe will:
Check that your solicitor or direct-access client (Client) recognises the invoices that you have approved;
Cause Omniveta Finance Pty Ltd (ABN 78 160 834 579) (Omniveta) to make an initial payment of at least 85% of your invoice (incl. GST) within three (3) business days of your Client recognising your invoice; and
Cause Omniveta to make a further payment of up to 94% of your invoice (incl. GST) within two (2) business days of your Client making a timely payment to Billbe of the amount you invoiced (where timely payment means the 30 day payment term standard in most barrister costs agreements, and payments later than 30 days reduce the size of the further payment to you).
In other words, besides a traditional fees-clerk service, Billbe will pay up to 94% of your invoice in exchange for you assigning your invoice and your Client paying 100% of the assigned debt to Billbe within the standard payment term of 30 days.
To register to use the time recording feature, you must click the I accept dialogue box next to the Time Recording -Terms and Conditions of Use on the next page (see "Step 1"). Doing so commits you to a binding contract wherein the time recording and invoicing functions of the Service is licensed to you by Billbe for no charge.
To register for the prompt payment of your invoices you must click the I accept dialogue box next to the Services Contract on the next page (see "Step 2"). Doing so commits you to an arrangement with Omniveta that crystallises into a binding contract whenever you approve an invoice for assignment.
To assign the benefit of the client costs agreement underpinning those invoices that you select for payment, you must print, sign and return to Omniveta Australia Invest Pty Ltd (ABN 12 160 834 677) the document entitled "Assignment Contract" (see "Step 3").
The payment aspect of the Billbe service also requires you to upload the costs agreements that undperin the invoices you refer to. If you do not have a costs agreement template of your own, you should consult the Costs and Billing page of the NSW Bar Association website (see http://www.nswbar.asn.au/for-members/costs-and-billing) and consider the precedent costs agreements for use under both the Legal Profession Act 2004 (NSW) (pre 30 June 2015 briefs) and the Legal Profession Uniform Law (post 30 June 2015 briefs). Billbe will review your costs agreements for compliance with the obvious requirements of the relevant legislation and will also use the information in the costs agreements to perform a credit check (acceptance of an invoice by Billbe is subject to a credit check).
It is likely that the terms of the agreements highlighted above (Agreements) will change over time, including, as a result of barrister feedback. In the event of material changes, we will notify you by displaying a prominent notice on the home page of the website or by sending you an email. Your continued use of the Service following such notifications will constitute acceptance of the changes.
If you wish to review the terms of the Agreements, the up-to- date versions of the Agreements can be found on the Billbe website under the "Administration" menu item. By clicking on the "I accept"" dialogue boxes referred to above, you acknowledge that you have read and understood the Agreements, accept the Agreements, and agree to be bound by them. If you do not agree with the Agreements or cannot comply with the Agreements, you may not use the services being offered.
